What Criminal Offense is this? Topic: Another case solved
July 20, 2019 / By Hannah
Question: So this guy cheats on his wife with his co-worker. The mistress then texts the wife and tells her about it, and tells her to get away from them. The wife is about to file a divorce, but the mistress continuously annoys the wife. The wife knows that co-workers can't have such relationships between themselves. She finds naked pictures of the mistress and sends it to their manager (boss, director..) The mistress files a complaint against the wife. Question. What offense is this called? How do we solve this case?

It's called MYOB. That means: Mind Your Own Business. A marriage is a legal contract, a business in itself and the two principle owners are the husband and the wife. They and only they choose and decide what will or will not affect the contract.

Of course it is. I suggest you talk to the police and if you have any the messages they sent to eachother show them. They can track her down and have her arrested.

I don't know if it is unlawful but it is certainly despicable. You are in a unique "between a rock and a hard place" position here. Who is your brother's lawful guardian? Because if it is your aging mother then it is most definitely time to switch that over to yourself, if you are willing to bear that burden, or the state might be even better. That way, when he is off his meds, you can simply call the police and commit him. However in doing so, you are sure part of the conspiracy then aren't you. If you get the state to claim guardianship for your brother, then perhaps it is also time to get him in a group home if he isn't already. That way professional staff and social workers will be providing help, services, and structure for your brother. And it also creates a third party to put in between him and your family, and for him to focus his paranoid aggression upon. This woman and her family are monsters looking to cash in on someones sickness. Comparable to gold digging women who marry elderly men, or older men preying on teenage girls. Even if it makes your brother hate you or think you are after him, you must do everything in your power to cut his ties with this woman and the only way of doing that is to get the authorities involved. Quite frankly it may become a matter of public safety in the end and you must take decisive action.

Cheating is not illegal. Telling a woman to stay away from her husband is not illegal. However, contacting her repeatedly could allow the wife to get an order of protection. If the woman then violates that order, that would be a criminal offence. Distributing naked photos is not illegal. You do not say how she came to have them. If (for example) they were on the home computer, she did not do anything illegal. If she hacked into girlfriend's iCloud account to get them, that was theft.

NOTHING you state is a CRIMINAL offence. There are several possible civil complaints, but absolutely NO criminal issues.

We didn't get the complete story, but I am assuming that the old man killed the young man? In any case, whoever the old man murdered, it is possible that the onset of some form of dementia may have played a role and caused him to react in a manner that was out of character for him.
