Question: About a month ago I had a seizure while driving, I do not have epilepsy. My body was fighting an infection which caused it. I hit a house, there were no injuries and no people involved. I have since went to the home owner and offered to pay any deductible or out of pocket money, she was very nice and said she was glad no one got hurt and that She had been out no money. Upon the police showing up it turns out my License was suspended 11 days prior, for a failure to appear. I had been to the DMV 7 days prior to this all of this happening, where I had to get new registration a change of address and pay for everything. It was about $250.00 higher then the renewal for registration had said, so I thought that everything was taken care of. Now here is where it gets interesting, I had not received a notice and I know you don't have to get a notice if you signed the ticket. I called the court house and they said they were very behind and an automatic extension was granted. I had no idea my license was suspended, I have since taken care of it, paid the fine and was offered traffic school which I am taking. I have no prior driving on a suspended license, there was no alcohol or any other substances in my body and the Dr. did write a letter saying it was a seizure that I had. Stupidly after having this seizure and hitting the home I drove a block away to my house. Where I then flagged down an officer to tell him what happened. I was very confused after having the seizure and am now on medication which completely blocks the possibility of having another seizure. I have hired council, who was very expensive since these are 2 misdemeanor offenses. With no prior accidents, no DUI's or DWI's the only thing I have ever had in my 15 years of driving were infractions. I know what my attorney told me, he said that he can more then likely get the driving on a suspended thrown out since I had stayed in touch with the courthouse, went to the DMV 4 days after the suspension was issued, paid what I thought was the fine, was given new registration and a change of address. How was I not to think it had been taken care of. What does anyone on here think the chances of me going to jail are, since I have since taken care of the suspension, paid the fine, did traffic school and have no prior accidents or driving on a suspended license. I have no criminal record, have a great job a great family but made a stupid decision in leaving the seen to back to my home after wards. I would be o.k. with probation and paying a fine, but no jail time. What are my odds I have retained council, he came very highly recommended and has the highest rating on attorney.com. He was not cheap, but then again I do not want to roll the dice and face the possibility of jail since it was charged as a hit and run. I have also made it financially right to the home owner, so she would not be out any money. Immediately after being released on my O.R. I went directly to the the house who's basketball hoop got totaled and gave them the money for a new one, which they have already bought and put up. I should note that the cost to fix the house I hit was $4,000.00. It has been taken care of by insurance.

With your circumstances I agree with the first poster~but if you could get a lawyer they would make it a better case for you~or ask the judge if you could get a court appointed attorney as you do not have the money~~but you probably will get probation and a fine

Learn how to drive within the law. Your opinion of wether you are safe or not does not matter. The tickets and other incidents under the law show differently.

So you started gettting speeding tickets at 16, and been in an accident already. And of course you got tagged at ONLY 5 mi over the limit. and the accident wasn't your fault..... You sound like you need a wake up call; hopefully this is it. (for the record, I have pretty much the same driving record as you; but I've been driving since 1972)

Upon interpreting your question, I end which you lack the skill to signify your self contained in the dmv listening to. you won't be able to clarify your place and you don't be conscious of what's going to stress the call.

Well, it sounds as if she might have been overly rude, but she probably did the right thing. Driving is a responsibility, not a right.

You can be arrested for driving on an out of state suspended license. A reciprocity agreement exists between every state. Meaning you won't have to sit in jail but if you don't show up for court you will have a warrant issued for you and your license will be suspended in both states. Now as for not knowing - there is a precedent for this - case law says a driver not properly notified or one who should not know the license is suspended is not guilty of the offense. Off the top of my head I cannot remember that case law, but a first time offender who had no prior knowledge of the suspension is not guilty

Okay I'm the guy who posted the question. I got a marijuana charge 2 and a half years ago. Nobody told me anything about a suspended license. I was 15 didn't even have a permit. Now 2 and a half years later I get pulled over they tell me I have a suspended license in a different state. That's how I found out because I never got a letter telling me. I just want to go to work and move on with my life. The cop who pulled me over said something like "You're lucky you got pulled over here or your license would be revoked". I just want to move on with my life this is so depressing. *sigh*.

Nope.. they can cite you.. the different states all have a jurisdictional agreement regarding such (and many more laws, having nothing to do with D/L's) Your license wont be suspended again.. it was already suspended.. you are in more trouble now... and in 2 different states now. How could you not know your license was suspended? Even i cant believe that one... You may get revoked now.. and def a few fines. maybe a little jail time... (you are planning to do a FTA (failure to appear) in that other state arent you? tell the truth... can you spell BENCH WARRENT?
