Question: my husband came to UK on a dependent visa. me and m family helped him settle here find a job etc. he kept mentally torturing me saying he hates this country and wants to go back to India. h e was sickenlingly attached to his cousin and he emailed her everyday. we practically had arguments everyday untill one day he abandoned me and left to india. I was missing him so much so i was nely making plans to give up my job etc and go to settle in india with him. he never kept any contact with me he just kept saying he wants to divorce me and if this marriage has to work i must accept his cousin. then i found out he has used my visa without informing me he is back in UK. he has been constantly swearing at me and abusing me. I wrote to the homeoffice but i did not hear anything. he is still here in UK on my visa treats me like dirt. i want to file for divorce but he needs to be present to sign the papers. Can anyone help me or advice me . he has also overdrawn a lot of money from his bank and i am recieving letters home. Please someone advise me what can i do? This man has destroyed my home and mental peace. Can i sue him if yes on what grounds. many thanks in advance he tried withdrawing from our joint account but luckily i blocked it way before. he has withdrawn from his own account but i am recieving letters on my address from the debt collectors.

I don't know divorce laws in the UK, so I would suggest you go to your local legal office or call a lawyer asap. Or you could try googling and researching divorce laws in your country.

rat him out to immigration authorities - tell them he defrauded the system - maybe they will deport him, in the hold of a cargo ship and drop him the slums of wherever the bad slums in India are - if he hates it so much why doesn;t he just leave? I hope the bank account he overdrew was not a joint account and that you have your own separate acct

once you file the papers in a court of law, you can be granted the divorce even if he doesn't sign it. (divorce by default.) just have the courts deliver the papers to him not to add to your heartbreak but I think the girl might be his better half and not his cousin

get yourself a good solicitor asap, look in yellow pages and get back on to the home office again and report him to immigration department tomorrow morning, this is not a mistake, this is experience but learn by your lesson

No. Overstay of a visitors visa of more than 1 year carries a 10 year ban from reentering the US after you've left. Since based on what you write you overstayed considerably more than 1 year there isn't any basis of appeal. If you have left 6 years ago you have 4 more years to wait. Marriage to an US citizen doesn't change anything. To change anything that spouse needs not only to marry you, but sponsor you successfully for a greencard. Since none of your husbands has apparently done that you just have been a visa overstayer all that time.
